HAMLINE UNIVERSITY LOAN AGREEMENT CONDITIONS COVERING LOANS
1. Borrowed objects will be held and returned in the same condition in which they were received. They will be shown and housed in facilities with fire protection, security, as well as environmental controls. Borrowed objects will be handled only by authorized and experienced personnel. Borrowed objects shall not be unframed, unglazed or removed from mats, mounts or bases, cleaned or repaired except with the express written permissions of the lender, or when the safety of the object makes such action imperative.
2. Loans shall remain in the possession of Hamline University in the exhibition in question for the time specified on the Loan Agreement, but may be withdrawn from exhibition at any time by the Director of Exhibitions at Hamline University. If an object is withdrawn the lender will be notified in writing within five (5) business days.
3. Unless Hamline University is notified in writing to the contrary, loans will be returned only to the owner at the address stated on the face of this agreement. If the legal ownership of the work should change during the period of this loan, whether by reason of death, sale, insolvency, gift, or otherwise, the owner will, prior to its return, be required to establish his/her legal right to receive the work by proof satisfactory to Hamline University. If the address of the new owner should be of much greater distance than the locality from which the loan was borrowed, the new owner will be required to pay any difference in the charges for the delivery of the work.
4. Unless the lender expressly elects to maintain his/her own insurance coverage, Hamline University will insure this loan while in its possession under its property policy for the appraised or street value indicated on the Loan Agreement against risk of physical loss or damage from any external cause during the period of the loan. The policy referred to contains the usual exclusions of loss or damage due to such causes as wear and tear, gradual deterioration, moths, vermin, inherent vice, war, hostilities, insurrection, nuclear reaction or radiation, and for damage resulting from any unauthorized repairing, restoration or retouching process.
5. The lender agrees to U.S. Government Indemnity, if applicable to this loan, at U.S. dollar value as of the date of this loan agreement.
6. If the lender elects to maintain his/her own insurance, Hamline University must be supplied with a certificate of insurance naming Hamline University as an additional assured or waiving subrogation against Hamline University and its insurance carrier. Otherwise, the loan agreement shall constitute a release of Hamline University from any liability in connection with loaned property. Hamline University cannot accept responsibility for any error or deficiency in information furnished to the lender’s insurers or for lapses in coverage.
7. Unless permission to do so has been specifically denied in writing by the lender at or prior to the time agreement is issued, Hamline University is authorized to photograph and/or reproduce in any media the object(s) listed in the Loan Agreement for archival, educational, and publicity purposes, and for sale by Hamline University. The signatures below indicate the conditions of this loan as stated above are accepted.
